You should never pay a speeding ticket or a traffic citation without first consulting an attorney. Traffic citations are considered either a moving violation or a non-moving violation. Non-moving violations will not impose points on your driving record. However, if you pay a speeding ticket or a moving violation, your driving record and license will suffer by accumulating points. The points on a speeding ticket or moving violation will range anywhere from 3 to 6 points depending on the violation (See Table Below). Having points on your license will likely cause an increase in your car insurance rates over the next 3 to 5 years.

There are many ways to beat a speeding ticket or moving violation. The first and foremost is that the speeding ticket or moving violation is procedurally wrong. By this I mean that the officer left something off the speeding ticket or moving violation that must be written on the ticket in order to be a legal ticket. I am very familiar with the rules regulating speeding tickets and traffic infractions and when you call me, I can evaluate your speeding ticket or moving violation to see if it is legally sufficient. If you allow me to fight your ticket for you, I promise to ask for a hearing or trial. I will hold the officer to the burden of proving you committed the moving violation beyond a reasonable doubt.
Secondly, the officers are burdened by a need to comply with very specific rules regarding speed measuring devices and traffic procedure rules. I am very familiar and fluent with these rules and if the officer does not comply with them, I will file a motion to have your ticket dismissed. Additionally, even if the officer has complied with all the specific rules I can still negotiate an outcome that will include no points on your driving record. Also, keep in mind that having points on your license can end up in a license suspension. If you have 12 points within 12 months the Department of Highway Safety and Motor Vehicles will suspend your driving privilege for 30 days. If you have 18 points, within 18 months your license will be suspended for 3 months. The penalties are greater the more violations you have and moving violations can affect your driving privilege for up to five years.
