Sections 943.0585 – 973.059 and Chapter 11C-7 of the Florida Administrative Code. Expungment: If you Expunge your record, you can lawfully deny the existence of the charges when applying for jobs in almost every place, except in very limited circumstances. Moreover if your record is Expunged you do not have to disclose it when purchasing a gun. A record that is Expunged is ordered to be physically destroyed by all law enforcement agencies having custody of it, except for one copy which is held by FDLE (Florida Department of Law Enforcement). You can only have one criminal history Expunged. Additionally, you can only expunge your criminal charges if they were dismissed prior to trial either through an intervention program or a motion. Once your charges are Expunged the only copy that is left is with FDLE and no one can have access to it without a Court order. Sealing: If you Seal your record, you can also lawfully deny the existence of the charges when applying for jobs in almost every place, as with an Expungment. However, when your record is Sealed you will have to disclose it, if you chose to purchase a gun. A record that is sealed is only available to you, your attorney, criminal justice agencies only for criminal justice purposes, Judges, and certain employment groups. You can only have one criminal history sealed or expunged, but not both. You can have your charges Sealed, if you received a Withhold of Adjudication on your charges and your charges were not:
Arson, Aggravated Assault, Aggravated Battery, Illegal Use of Explosives, Child Abuse, Abuse of an Elderly Person, Abuse of a Disabled Person, Hijacking, Kidnapping, Homicide, Manslaughter, Sexual Battery, Robbery, Carjacking, Lewd Assault on a Child under 16, Sexual Activity with a Child 12 to 18, Burglary of a Dwelling, Stalking, Aggravated Stalking, Trafficking in Drugs, Voyeurism or Any offence that would require registration as a sexual predator or sexual offender.Additionally, before you can apply to seal your record all parts of your sentencing must be complete including all probation, restitution and court cost.
